Description

This session will focus on untangling the web of laws that address access to housing, including the Architectural Barriers Act, the Americans with Disabilities Act, the Fair Housing Act, and Section 504 of the Rehabilitation Act. Presenters will engage in a more “advanced“ level discussion of how the design requirements of these laws apply and review requirements in the ADA and ABA Accessibility Guidelines for residential dwelling units. Participants interested in this session are encouraged to review archived sessions on this topic for a review of the basic provisions.

Questions for presenters:

1 Communication feature dwelling units require the common or public use side of the bldg entry to be capable of supporting TTY if a system provides voice communication per 708.4.1. Does this mean a shelf and an electrical outlet should be provided per 704.5? If not, what does this mean?
2 Does the thermostat controls inside the kitchen refrigerator have to be within reach range?
3 Ambulatory toilet requirement. 1991 ADA 4.23.4 section states that if you have more than 6 fixtures, at least one has to meet ambulatory toilet requirement. I am not able to find this requirement in ADA 2010. Where in ADA 2010 states where and how many to provide ambulatory toilet ?
4 In an assisted living facility, accessible unit, where the tenants have 24-hr access to assistance, does the 5lb operating force for a window vent apply?
5 For the answers provided to any of the questions, can you please provide answers for FHA, ADA and UFAS facilities; draw the distinctions. Also, please clarify whether the item cited is out of a specific ICC version (as referenced in ADA OR a Safe Harbor per FHA). Citations will be very helpful!!!
6 Social service center establishments follow residential requirements. If there is a common space kitchen supporting sleeping rooms, does it require a work surface? And can that work surface have removable cabinetry?
7 Is removable cabinetry allowed under a kitchen work surface or sink for student housing?
8 Walk-in closets that are not off a mobility feature room in a multi-bedroom dwelling - do they require a 60" turning space? What if it were an semi-enclosed alcove off of a non-mobility sleeping room
9 For Social Service Center Establishment facilities (under residential), how do I calculate 5% & 2% if I have a facility with both sleeping rooms & a number of 'apartments' with multi-bedrooms, some with their own bathing rooms and some with common-use bathing rooms ? Please discuss this issue
10 For Social Service Center Establishment facilities (under residential), common-use shared shower rooms and toilet rooms - is the only requirement for a roll-in shower with seat and grab bars, or does a toilet also need to be accessible with grab bars?
11 In the regs, it states the following - (3) Facilities with residential units and transient lodging units. Residential dwelling units that are designed and constructed for residential use exclusively are not subject to the transient lodging standards. For the residential use - does this mean for TIII that they are not covered or that they are covered as residential under the ADA?
12 How do the ADA/ABA requirements for residential facilities compare to the IBC requirements for residential facilities?
13 What are the specific regulations that cover existing college campus residential facilities? Does the scoping change for new construction or renovated space?
14 UFAS section 4.6.6 states "if accessible van parking is provided, then the minimum vertical clearance should be 114 in. Does this mean the vehicle access routes to van parking from site entrances shall also need 114 in. clearance? Please explain the requirement for the reach ranges for controls above the kitchen counters as per UFAS.
15 Requirements in building an accessible house that could be put on the market, be marketed as usable by all: include persons with physical, sensory and intellectual disabilities?
16 I understand that Section 504 of the Rehabilitation Act is now a DIFFERENT section number because of some amendment(s) to the Act. That makes the provision itself very difficult to find. (I once had a book that detailed this, but can't locate it now.) If this is correct, what is the current law and section/subsection number, and can appropriate agencies change to referring to it that way?
17 When an organization wants to start a group home such as Foster care for boys & girls what law does the organization facilities follows?
